SOLIDARITY OF FILIPINO WORKERS (BMP)

PREYAMBULO

Kami, mga Manggagawang Pilipino na may kamalayang pampulitika at kamulatan sa uri at kaming mula sa ibang sektor na nananalig at nakikiisa sa dakilang simulain ng uring manggagawa, batid ang sukdulang kaapihang dinaranas ng masang anakpawis sa ilalim ng mapang-aliping kapangyarihan ng kapital at lahat ng uring mapagsamantala, batid ang pangangailangang walang humpay na ipaglaban ang kapakanan at kagalingan ng uring manggagawa at makiisa sa ibang uring naaapi, batid ang pangangailangang pukawin, pagkaisahin at pakilusin ang uring anakpawis para sa katuparan ng sosyalistang adhikain, at batid ang pangangailangang pangunahan ng uring manggagawa ang pakikibaka ng sambayanang Pilipino para sa demokrasya, kalayaan at kasarinlan; pangunahan ang laban ng buong uring anakpawis para sa katuparan ng sosyalistang adhikain, ngayon ay pinagtibay ang Saligang Batas na ito para patnubayan ang ating Bukluran.

PREAMBLE

We, Filipino workers who have political awareness and class consciousness and we from the other sectors who have faith and in oneness with the great vision of the working class, aware about the extreme oppression experienced by the working masses under the exploitative power of capital and all oppressor class, aware of the incessant need to fight for the welfare and well-being of the working class and unite with other oppressed classes, aware of the need to excite, unite and mobilize the working class for the realization of the socialist cause, and aware of the need for the working class to lead the Filipino people for democracy, freedom and independence; to lead the struggle of the entire working class for the realization of the socialist cause, now adopted this Constitution that will guide our Solidarity.

ARTIKULO I

PANGALAN NG ORGANISYON

Seksyon 1. Ang ating samahan ay makikilala sa pangalang BUKLURAN NG MANGGAGAWANG PILIPINO at maaaring tawaging BMP.

Seksyon 2. Ang kasalukuyang sagisag at logo ng BMP ay ang dalawang kamay na may tig-isang hawak na maso at may dalawang magkaharap na karit sa likod nito at may BMP sa gitna.

Seksyon 3. Ang opisyal na awit ng BMP ay ang BMP Hymn at kinikilala ng BMP ang INTERNASYUNAL bilang pandaigdigang awit ng manggagawa.

Seksyon 4. Ang punong himpilan ng BMP ay matatagpuan sa Kalakhang Maynila.

ARTICLE I

NAME OF THE ORGANIZATION

Section 1. Our organization will be known as BUKLURAN NG MANGGAGAWANG PILIPINO (SOLIDARITY OF FILIPINO WORKERS), and will be known in its acronym BMP.

Section 2. The current symbol and logo of the BMP has two hands with each one holding that hammer and two facing sickle behind it and BMP in the middle.

Section 3. The official song of BMP is the BMP Hymn, and BMP recognizes the International as universal song of the workers.

Section 4. The main headquarters of the BMP will be found in Metro Manila.

ARTIKULO II

DEKLARASYON NG MGA PRINSIPYO AT LAYUNIN

Seksyon 1. Ang katas-tasang prinsipyo ng BMP ay adhikain at dalisayin ang papel ng uring manggagawa sa lipunan at kasaysayan at sa lahat ng sandali’y maninindigan at makikipaglaban sa interes at simulain ng uring manggagawa. Ang lahat ng ikinikilos ng BMP ay dapat magmumula sa makauring pananaw na ito at dito siya dapat masubukan at makilala.

Seksyon 2. Naniniwala ang BMP na;

a. Ang pundamental na interes ng uring manggagawa ay ang pagsusulong at kaganapan ng kanyang makauring pakikibaka mula sa antas pang-unyon hanggang panlipunan.

b. Ang tanging makahihigit sa importansya sa prinsipyo sa tunggalian ng uri ay ang interes ng uring manggagawa para sa progresong panlipunan. Ang makauring tunggalian at progresong panlipunan ang dalawang saligang interes ng uring manggagawa.

c. Ang dalawang saligang batas na ito ay kapwa kinakatawan ng sosyalistang misyon ng manggagawa sa kasaysayan.

Seksyon 3. Ang makauring pagkakaisa ang siyang magiging batayan ng pagsulong ng isang malakas na kilusang manggagawa. Ang pagkakaisang ito ay hihinangin sa pamamagitan ng pag-oorganisa at pagpupunla ng makauring kamulatan sa masa ng uring manggagawa. Sa batayang ito dapat ipundar ang organisadong lakas ng BMP, at ito ang maaaring magsilbing matibay na gulugod upang sumulong ang kilusang unyon sa bansa. Ang integrasyon ng sosyalistang kamalayan sa pang-unyong pakikibaka ay kakatawanin nito.

Seksyon 4. Ngunit ang paglaya ng uring manggagawa sa karukhaan at kaapihan ay di makakamit sa kaparaanan lang ng pag-uunyong pakikibaka na ang maksimum na makakamit ay ang pag-igihin at paalwanin ang kalagayan at kasunduan ng pagpapailalim sa kapangyarihan ng kapital. Ang paglaya ng manggagawang Pilipino ay magaganap lamang kung ang kanyang pananaw, pagkakaisa at pakikibaka ay lalampas sa makitid na pader ng kanilang mga pabrika’t empresa, at iigpaw sa antas ng makauring kamalayan, pagkakaisa at pakikibaka para sa saligang tungkuling baguhin ang sistemang mapagsamantala. Narito ang saligang katuturan at simulain ng BMP, ang pukawin, organisahin at pakilusin ang masang manggagawa laban sa kapitalismo bilang sistema at itanghal ang sosyalismo bilang ultimong simulain at adhikain ng uring manggagawa sa bansa at sa buong mundo.

Seksyon 5. Sa kasalukuyang antas ng pag-unlad ng lipunang Pilipino, ang paglaya ng uring manggagawa ay nakasalalay sa paglaya ng buong sambayanang Pilipino. Ang sosyalistang adhikain ng uring manggagawa ay magkakaroon ng katuparan kung susulong ang progresong panlipunan sa bansa sa kasalukuyang atrasadong kapital at kapangyarihan. Sa batayang ito, ang simulain ng sambayanang Pilipino para sa kalayaan at demokrasya ay simulain din ng manggagawang Pilipino at ang landas patungong sosyalismo ay ang landas ng pakikibaka para sa demokrasya’t kasarinlan ng bansa. Tungkulin ng manggagawang Pilipino hindi lamang itaguyod ang pakikibakang ito para sa demokrasya’t kalayaan kundi pangunahan ang buong sambayanan sa pakikibakang ito. Ang uring manggagawa sa lungsod at kanayunan ang pinakamakapangyarihang pwersang makapagbubunsod ng pakikibakang ito, at sa lahat ng uri, ang manggagawa ang may pinakamalaking interes sa ganap na pananagumpay ng pakikibakang ito sapagkat sa pagkamit ng demokrasya’t kasarinlan mahahawan ang pakikibaka patungo sa sosyalismo.

Seksyon 6. Dahil ang pang-aapi sa uring manggagawa bilang mga sahurang alipin ay isang pandaigdigang sistema, ang pakikibaka ng manggagawang Pilipino ay di maiiwasang magkakaroon ng internasyunal na katangian. Mismo ang paglaya at pag-unlad ng bansang Pilipinas ay di magkaroon ng ganap na katuparan hangg’at ang kapangyarihan ng imperyalismo ay naghahari sa buong daigdig. Ang ganap na katuparan ng sosyalistang misyon ng uring manggagawa sa mga bansang gaya ng Pilipinas ay mapagpasyang nakasalalay sa pagsulong ng internasyunal na kilusan ng uring manggagawa laban sa pandaigdigang kapital at kapangyarihan ng imperyalismo. Sa batayang ito ang panawagang “Manggagawa sa lahat ng Bansa, Magkaisa” ay isang sentral na prinsipyo para sa BMP, at ang pakikibaka’t pananagumpay ng manggagawang Pilipino laban sa paghahari ng imperyalismo sa bansa ang pinakamalaking ambag natin sa kilusang manggagawa sa buong daigdig.

ARTICLE II

DECLARATION OF PRINCIPLES AND OBJECTIVES

Section 1. The highest principle of BMP is to aim and purify the role of working class in society and history and at all times will stand and fight for the interests and principles of the working class. All actions of the BMP shall came from this class perspective and here he should be tried and be identified.

Section 2. BMP believes that:

a. The fundamental interests of the working class is the advancement and fulfillment of his class struggle from the union level to political.

b. The only important thing that can exceed the principle of class struggle is the interest of the working class for a progressive society. Class struggle and social progress are the two basic interest of the working class.

c. This two basic interests is both represented by the worker's socialist mission in history.

Section 3. Class unity will be the basis for the promotion of a strong workers' movement. This unity will be welded through organizing and planting class consciousness among the masses of the working class. On this basis we shall establish the organized strength of BMP, and this can serve as a strong backbone for the trade union movement in the country to move forward. This will be represented by the integration of socialist consciousness on the union struggle.

Section 4. But the emancipation of the working class from poverty and injustices cannot be achieved through trade union struggle only, the maximum gain is the improvement and ease the situation and agreement of subordination to the power of capital. The emancipation of the Filipino workers can only happen if his vision, unity and struggle would exceed the narrow walls of their factories and enterprises, and leaps in the level of class consciousness, solidarity and struggle for fundamental change of the exploitative system. Here are most basic importance and principles, to arouse, organize and mobilize the working class against capitalism as a system and to present socialism as the ultimate goal and aspirations of the working class in the country and around the world.

Section 5. At the current level of development of Philippine society, the liberation of the working class depends on the liberation of the Filipino people. The socialist cause of the working class will be realized if social progress will go forward in the country from the current backward state due to remnants of feudal order and stunted by the imperialist capital and power. In this basis, the aspiration of the Filipino masses for liberty and democracy is also the aspiration of the Filipino workers, and the path towards socialism is the path of struggle for democracy and freedom of the country. It is the duty of the Filipino workers, not only to promote this struggle for democracy and liberty, but to lead the whole people in this struggle. The working class in the city and the countryside is the powerful force that can launch this struggle, and to all classes, the workers have the greatest interest in the complete victory of the struggle because through attaining democracy and liberty will clear the path of struggle towards socialism.

Section 6. Given the long oppression of the working class as wage slaves of capital is a global system, the struggle of Filipinos workers will inevitably have an international character. The liberation and development of the Philippines will not be realized as long as the power of imperialism rules the world. The full realization of the socialist mission of the working class in countries like the Philippines is decisively dependent on the growth of the international working class movement against global capital and power of imperialism. In this basis, the call "Workers of All Countries, Unite" is a central principle for BMP, and the struggle and victory of the Filipino workers against the domination of imperialism in our country is our greatest contribution to the workers' movement in the world.

ARTIKULO III

KASAPIAN

Seksyon 1. Pagsapi. Ang sinumang indibidwal, grupo, o organisasyon na nananalig sa Saligang Batas ng BMP at naniniwala sa sosyalistang adhikain nito ay maaring maging kasapi o sumapi sa BMP.

Seksyon 2. Ang mga indibidwal na may namumukod na kontribusyon sa kilusan ng uring manggagawa ay maaring tanggapin bilang kasapi alinsunod sa kapasyahan ng komite sentral ng BMP.

Seksyon 3. Ang mga organisasyong maaring sumapi sa BMP ay mga unyon at asosasyon, mga sosyalistang organisasyon at pederasyon ng maralitang lungsod at maralitang bukid, mga samahan ng kabataan, kababaihan at pangkultural at iba pang sosyalistang organisasyon.

Seksyon 4. Ang aplikasyon para sa pagsapi ng isang organisasyon ay dapat pagtibayin ng Pambansang Komiteng Tagapagpaganap (PKT) o ng awtorisadong katumbas nito sa pangrehiyong antas matapos matupad ang mga rekisitong itatakda ng mga kapulungang magpapatibay sa aplikasyon.

Seksyon 5. Mga karapatan ng kasapi. Ang mga kasapi ay mayroong mga sumusunod na karapatan:

a. Lahat ng delegado sa kongreso ay may karapatang bumoto, kumandidato at mahalal sa anumang posisyon.

b. Ang lahat ng kasapi ay may karapatang lumahok at magbigay ng opinyon at posisyon sa mga talakayan at debate sa loob ng organisasyon.

c. Ang lahat ng kasapi ay may karapatang magpaabot ng mga panukala sa BMP, mga organisasyong kasapi nito at puna sa sinumang kasapi, pamunuan at kapulungan ng BMP.

d. Ang lahat ng kasapi ay may karapatang alamin ang kalagayan ng organisasyon tulad ng pinansyal, kasapian at iba pa.

e. Ang sinumang organisasyon / indibidwal ay maaring magbitiw bilang kasapi pagkatapos na maipaabot ang mga kadahilanan at madidisyunan ng karampatang kapulungan na bubuuin ng PKT.

f. Ang lahat ng mga kasapi ay may obligasyong pangalagaan ang interes at integridad ng organisasyon.

Seksyon 6. Mga obligasyon ng kasapi. Ang lahat ng kasapi ay may mga sumusunod na obligasyon:

a. Dumalo sa mga pulong na ipapatawag ng BMP

b. Ang lahat ng kasapi ay may obligasyon na dumalo sa mga pag-aaral ng mga kursong pinagpasyahan ng komite sentral ng BMP.

c. Ang lahat ng kasapi ng organisasyon ay may obligasyong tangkilikin ang lahat ng isyu ng Tambuli at iba pang opisyal na lathalain ng BMP.

d. Ang lahat ng kasapi ay may obligasyong magbigay ng butaw para sa pondo ng organisasyon.

e. Ang lahat ng kasapi ay may obligasyong lumahok sa lahat ng napagtibay na pagkilos at panawagan ng BMP.

f. Ang lahat ng kasapi ay may obligasyong palawakin ang kasapian ng BMP.

ARTICLE III

MEMBERSHIP

Section 1. Membership. Every individuals, groups and organizations that believe in the BMP Constitution and believes in its socialist aim can become a member of BMP.

Section 2. Individuals who have outstanding contributions to the working class movement can be accepted as members in accordance with the decision of the Central Committee of the BMP.

Section 3. Organizations that can join BMP are unions and associations, socialist organizations and federations of urban poor and rural poor, youth organizations, women and cultural and other socialist organizations.

Section 4. The application for membership of an organization must be adopted by the National Executive Committee (NEC) or its authorized equivalent at the regional level after fulfilling the requirement set by the councils that will strengthen the application.

Section 5. Rights of members. The members have the following rights:

a. All delegates at the congress have the right to vote, run and be elected to any position.

b. All members have the right to participate and give opinions and positions in discussions and debate within the organization.

c. All members, individuals and member organizations, have the right to give their proposal to BMP, as well as comment on any members, officials and assembly of BMP.

d. All members have the right to know the status of the organization such as financial, membership and more.

e. Any organization / individual may resign as a member after stating the reasons and be decided upon by the competent assembly that will be organized by the NEC.

f. All members have an obligation to protect the interests and integrity of the organization.

Section 6. Obligation of members. The members have the following obligations:

a. All members have the obligation to attend to meetings set forth by the BMP

b. All members have the obligation to attend all study courses decided by the central committee decided of BMP.

c. All members of the organization have an obligation to patronize all the issue of Tambuli and other official publications of the BMP.

d. All members have an obligation to pay their dues for the organization's fund.

e. All members have an obligation to participate in all approved actions and demands of BMP.

f. All members have an obligation to expand the membership of the BMP.

ARTIKULO IV

ANG PAMBANSANG KONGRESO

Seksyon 1. Ang pinakamataas na kapangyarihan ay ang Pambansang Kongreso na idaraos tuwing ikatlong taon. Ito ay binubuo ng mga delegado mula sa mga kasaping organisasyon / indibidwal.

Seksyon 2. Ang Pambansang Kongreso ang magtitibay ng pangkalahatang programa at mga patakaran, mag-amyenda sa saligang batas at maghahalal sa mga kagawad ng komite sentral. Ihahalal din ng pambansang kongreso ang tagapangulo.

Seksyon 3. Ang ispesyal ng Pambansang Kongreso ay maaring idaos kung kinakailangan. Ang pagdaraos ng Ispesyal na Kongreso ay maaring ipatawag ng dalawang katlo (2/3) ng komite sentral o ng mayorya ng mga kasaping organisasyon.

ARTICLE IV

THE NATIONAL CONGRESS

Section 1. The highest authority is the national congress to be held every three years. It is composed of delegates from member organizations / individuals.

Section 2. The National Congress will approve the general programs and policies, to amend the constitution and elect the members of central committee. The national congress will also elect its chairman.

Section 3. A special national congress will be held if necessary. Observance of special congress will be convened by two thirds (2 / 3) of the central committee or majority of member organizations.

ARTIKULO V

KOMITE SENTRAL

Seksyon 1. Ang komite sentral (KS) ang pinakamataas na awtoridad sa pagitan ng mga kongreso na binubuo

ng 31 halal na kagawad at ng mga sumusunod na awtomatikong kagawad.

a. Ang mga pangulo ng unyong bumibilang ang kasapian ng 300 pataas:

b. Ang pangulong mga kasaping sosyalistang organissyon mula sa ibang lokal at

c. Ang pangulo o tagapangulo ng balangay ng buklod

Seksyon 2. Ang komite sentral ang maghahalal sa mga kagawad ng pambansang komiteng tagapaganap.

Seksyon 3. Ang Komite Sentral ay maaring bumuo ng mga kagawaran at komite na kinakailangan para sa pagpapatupad ng pangkalahatang programa at mga patakaran ng kongreso.

Seksyon 4. Ang komite sentral ay magpupulong ng isang beses kada anim na buwan.

Seksyon 5. Ang komite sentral ay may tungkuling:

a. Gumawa ng mga kailangang desisyon at patakaran kaugnay ng ginagawang programa ng kongreso.

b. Magtakda ng ispisipikong target bawat larangan ng trabahong kinakailangan para sa implementasyon ng programa.

c. Gumawa ng plano ng yugto-yugtong nahahati ng anim na buwan sa loob ng tatlong taon.

Seksyon 6. Maaring ipatawag ang ispesyal na pulong ng KS sa pamamagitan ng PKT o ng petisyon ng simpleng mayorya ng mga kasapi ng KS.

Seksyon 7. Ang sinumang kasapi ng KS na nakagawa ng pagkakasala tulad ng pagbebenta ng interes ng manggagawa at paglalagay sa panganib ng organisasyon at kasapian ay maaaring maigawad ang pagtatanggal sa tungkulin sa pamamagitan ng boto ng dalawang katlo (2/3) ng buong kasapian ng KS.

Seksyon 8. Ang Komite Sentral ay binibigyang kapangyarihang magdagdag ng kanyang kagawad sa panahong paubos na ang kanyang kasapi at habang malayo pa ang kongreso. Sa esensya ito ay ang kapangyarihang maghirang ng kapalit o dagdag sa mga di na aktibong kasapi na nakabatay sa prinsipyo ng cooptation.

ARTICLE V

THE CENTRAL COMMITTEE

Section 1. The central committee (CC) is the highest authority between congresses consisting of 31 elected members and the following automatic members:

a. Union presidents with membership of 300 and more;

b. The president of the socialist members from other local organizations; and

c. Presidents or chairmen of the chapters of buklod (nucleus of an organization)

Section 2. The central committee shall elect the members of the national executive committee.

Section 3. The Central Committee may develop departments and committees necessary for the implementation of the overall program and policies of Congress.

Section 4. The central committee will meet once every six months.

Section 5. The central committee has the duty to:

a. Make the necessary decisions and policy which are related to the programs made by congress.

b. Set specific targets for each area of work required for the implementation of the program.

c. Make a plan of stages divided by six months for three years.

Section 6. May call for a special meeting of CC by the NEC or the petition of a simple majority of members of CC.

Section 7. Any CC member who commit offenses such as selling workers' interests and putting the organization and membership at risk may be terminated from office through two thirds (2 / 3) vote of the entire CC membership.

Section 8. The Central Committee is given the power to add staff at the time there are members who lie-low and while congress is away. In essence it is the power to appoint a replacement or in addition to non-active members based on the principle of cooptation.

ARTIKULO VI

AKSYONG PANDISIPLINA

Seksyon 1. Ang sinumang kasapi ng KS na tatlong sunod na lumiban sa pulong nang walang matibay at sapat na dahilan at awtomatikong inaalis bilang kasapi nito.

Seskyon 2 Ang mga katanggap-tanggap na dahilan ay ang mga kasaping may malubhang karamdaman, may mahalagang misyon na may pahintulot ang pamunuan tulad ng iba pang gawaing inaatas o pagiging kinatawan sa mga kumperensya sa labas ng bansa.

Seksyon 3. Ang sinumang kasapi ng KS na magkakasala ay maaring alisin sa tungkulin matapos maganap ang anumang proseso (due process) na ipatupad ng KS.

Seksyon 4. Ang sinumang kasapi na pinagpasyahang nagkasala sa anumang antas ng kapulungan ay maaring umapela sa sumusunod na nakakataas na kapulungan ng organisasyon.

Seksyon 5. Ang sinumang kasapi na ang bigat ng pagkakasala ay tulad ng pagbebenta ng unyon at interes ng manggagawa at / o mga kasong kinasangkutang naglalagay sa panganib sa organisasyon ay maaring agarang patawan ng pansamantalang pag-alis sa tungkulin habang dinidinig ang kanyang kaso. Liban sa parusang pagtatanggal, ang KS ay maaaring magpataw ng mas mabigat na parusa depende sa bigat ng ginawang pagkakasala.

Seksyon 6. Ang KS ang siyang pangunahing binibigyang kapangyarihan na maglabas ng alituntunin ng mga disiplinang ito kaugnay sa pagharap sa mga kaso, katapat na mga kaparusahan at mga detalye ng kaakibat na prosesong ipapatupad. Para sa pagsasangkongkreto nito. Ang KS ay maaring magbuo ng ethics comittee na siyang mangangasiwa ng pagpoproseso ng mga kaso nang sa gayon ay matiyak ang karampatang due process.

ARTICLE VI

DISCIPLINARY ACTION

Section 1. All CC members after three consecutive absences without substantial and sufficient reasons are automatically removed as its members.

Section 2. The acceptable reasons are those members with serious illness, who has important mission with the consent of the leadership, such as works assigned or those who represent the organization in conferences abroad.

Section 3. Any CC member who committed an offense may be stripped of his duty after any procedure (due process) was done by the CC.

Section 4. Any member who has been convicted of offense in any level of the organization may appeal to the next higher level of organization.

Section 5. Any member who is guilty of selling the integrity of the union and the interests of workers and / or cases that put the organization at risk may be immediately temporarily stripped of his duty while his case is being heard. Except for the removal penalty, the CC may impose heavier penalties depending on the gravity of the offense.

Section 6. The CC is the main lead who have the power to draft rules of discipline in relation to dealing with cases, which corresponds to the penalties and details of the process enforced. In concretizing this, CC can form and ethics committee to oversee the processing of cases so we can ensure competent due process.

ARTIKULO VII

ANG PAMBANSANG KOMITENG TAGAPAGPAGANAP (PKT)

Seksyon 1. Ang Pambansang Komiteng Tagapagpaganap (PKT) ang pinakamataas na kapulungan sa pagitan ng mga pulong ng komite sentral. Ang PKT ay may sentral na tungkulin na ipatupad ang lahat ng desisyon, plano at programa ng Komite Sentral, kaakibat ng tungkuling ito ay ang karapatang magdesisyon sa lahat ng usaping may kaugnayan sa pagpapatupad ng mga desisyon ng KS.

Seksyon 2. Ang PKT ay bubuuin ng lahat ng pambansang opisyal. Maaring dagdagan ang bilang ng kagawad nito alinsunod sa desisyon ng Komite Sentral.

Seksyon 3. Ang PKT ay may kapangyarihang magpatawag ng kapulungan ng lahat na pangulo (KLP) ng binubuo ng lahat ng pangulo ng lokal na organisasyon at pinuno ng balangay ng buklod ay tinitipon upang mag desisyon kaugnay ng mga mayor na kampanya at mga pangkalahatang pamparalisang aksyon.

Seksyon 4. Ang Pambansang Pamunuan ay ang mga sumusunod:

a. Ang pangulo ang siyang pinakamataas na kinatawang opisyal ng organisasyon na ihahalal ng Pambansang Kongreso, ang nagpapatawag at nangangasiwa sa mga pulong ng Komite Sentral at Pambansang Komiteng Tgapagpaganap (PKT) at maaring bigyan ng ibang pang gawaing itatakda at pagkakaisahan ng Komite Sentral.

b. Ang Unang Pangalawang Pangulo. Siya ang tatayong National Executive Vice President at hahalili sa pangulo sa kalagayang hindi makagampan ang huli sa iba’t ibang kadahilanan. Maaring bigyan ng iba pang gawaing itatakda at pagkakaisahan ng Komite Sentral.

c. Ang Ikalawa, Ikatlo at Ikaapat na Pangalawang Pangulo. Magiging katuwang ng Pangulo sa lahat ng tungkulin at responsibilidad nito at maaring bigyan ng iba pang gawaing itatakda at pagkakaisahan ng Komite Sentral. Ang isa sa Pangalawang Pangulo ang itatalaga sa pag-aasikaso ng gawaing internasyunal.

d. Ang Pangkalahatang Kalihim. Siya ang pangunahing mangangasiwa sa mga arawang pagpapatakbo ng pangkalahatang gawaing pang-organisasyon.

e. Ang Pangalawang Pangkalahatang kalihim. Siya ang katuwang sa gawain ng pangkalahatang kalihim. Siya rin ang hahalili sa pangkalahatang kalihim sa kalagayang hindi makagampan ang huli sa iba’t ibang kadahilanan. Maaari siyang bigyan ng iba pang tungkulin o gawain na itatakda ng Komite Sentral.

f. Ang Ingat Yaman. Siya ang punong opisyal na nangangalaga sa lahat ng pondo at ari-arian ng organisasyon. Siya rin ay inaasahang regular na mag-uulat kada taon.

g. Ang Tagasuri. Ang punong opisyal na magtitiyak na regular na naisagawa ang auditing ng buong pondo at ari-arian ng organisasyon.

ARTICLE VII

THE NATIONAL EXECUTIVE COMMITTEE

Section 1. The National Executive Committee (NEC) is the highest body in the midst of the central committee meeting. The NEC has the central task to implement all decisions, plans and programs of the Central Committee, along with the responsibilities is the right to decide on all matters related to the implementation of the CC's decisions.

Section 2. The NEC is composed of all the national officials. The Central Committee may add members of its staff if they have decided upon it.

Section 3. The NEC has the power to call for an All Leaders Assembly (ALA) consisting of all the presidents of local organizations and leaders of chapters of the "Buklod" which will decide in connection with major campaigns and general paralyzing actions.

The National Leadership is composed of the following:

a. The president is the highest official representative of the organization elected by national Congress can call and oversee meetings of the Central Committee and National Executive Committee (NEC) and may be given other works set and unified by the Central Committee.

b. The First Vice President. He or she will stands as National Executive Vice President and will succeed the president if the late cannot function for various reasons. May be given other works set and unified by the Central Committee.

c. The Second, Third, and Fourth Vice President. They may assist the President in all his or her duties and responsibilities and may be given other works set and unified by the Central Committee. One of the Vice President will be assigned for international work.

d. The Secretary-General. He or she is responsible for administering the daily operation of the organization.

e. The Deputy Secretary-General. He or she will assist the secretary-general, and will replace the secretary-general if the late cannot function for various reasons. May be given other works set and unified by the Central Committee.

f. The Treasurer. He or she will be in-charge of the funds and property of the organization, and will regularly submit financial report yearly.

g. The Auditor. He or she is responsible for auditing all the funds and properties of the organization.

ARTIKULO VIII

BALANGAY SA MGA REHIYON AT PROBINSYA

Seksyon 1. Ang mga balangay ng BMP ay maaring itayo sa mga rehiyon o probinsya na may sapat na batayan alinsunod sa pagtatakda ng KS.

Seksyon 2. Ang mga balangay ng BMP ay may tungkuling regular na mag-ulat sa KS.

ARTICLE VIII

REGIONAL AND PROVINCIAL CHAPTERS

Section 1. BMP chapters may be organized in regions and provinces if there is adequate basis in accordance with the provisions of the CC.

Section 2. BMP chapters have an obligation to report to the CC regularly.

ARTIKULO IX

BUKLOD

Seksyon 1. Ang Buklod ang siyang itatayong batayang yunit ng BMP.

Seksyon 2. Ang mga nakapaloob na Buklod ay tatayong mga idibidwal na kasapi ng BMP.

ARTICLE IX

BUKLOD

Section 1. The Buklod (or Nucleus) is the basic unit of BMP.

Section 2. Those who functions as members of Buklod will be individual members of the BMP.

ARTIKULO X

MGA KAGAWARAN AT KOMITE

Seksyon 1. Ang mga sumusunod ang mga kagawaran at komite at gawain nito:

a. Ang Kagawaran sa Organisasyon. Ang magiging katuwang ng Pangkalahatang Kalihim sa mga gawaing pang-organisasyon laluna ang pagpapalakas at pangangalaga sa kasaping organisasyon.

b. Ang kagawaran sa Edukasyon at Propaganda. Magbabalangkas ng programa katuwang ang mga lokal na organisasyon sa pagtitiyak na ang lahat ng plano kaugnay ng gawaing edukasyon at propaganda ay naipatupad. Ang kagawarang ito ang mangangasiwa sa paaralang manggagawa.

c. Ang Kagawaran sa Kampanya. Magbabalangkas ng programa katuwang ang mga lokal na organisasyon sa pagtitiyak na ang lahat ng plano kaugnay ng gawaing kampanya ay naipatupad. Ang kagawarang ito ang mangangasiwa sa mga QRF at pagbubuo nito sa mga lokal na unyon.

d. Ang Komite ng Gawaing Kababaihan. Ang may pangunahing papel sa pagpapalaganap ng sosyalistang adhikain sa sektor ng kababaihan at sa pag-oorganisa ng kababaihan sa mga pagawaan, komunidad, paaralan at plantasyon.

e. Ang Komite sa Pagpapalawak (expansion comittee). Ang may pangunahing papel sa pagpapalawak ng kasapian ng organisasyon sa lahat ng pagawaan, sektor ng serbisyo at manggagawang bukid sa buong bansa.

f. Ang Komite sa Pananalapi (finance comittee). Ang may pangunahing papel sa pagpapasulpot ng pinansya at rekurso ng organisasyon.

g. Ang Komite sa Gawaing Pangkultura (cultural comittee). Ang may pangunahing papel sa pagpapalaganap ng progresibo at makauring kultura sa mga pagawaan, sektor ng serbisyo at komunidad.

h. Ang komite sa Gawaing Internasyunal. Ang may pangunahing papel sa pagpapalawak ng ugnay o network, makipagkapatiran at makapangalap ng suporta.

ARTICLE X

DEPARTMENTS AND COMMITTEES

Section 1. The following are the departments and committees and its functions:

a. Organizing Department. This will assist the Secretary General in organizational work especially in strengthening and protecting member organizations.

b. Education and Propaganda Department. They will outline the program with the local organizations in ensuring that all the plans regarding educational and propaganda work has been carried out. This department will manage the Workers School.

c. Campaign Department. They will outline the program with the local organizations in ensuring that all the plans regarding campaign work have been carried out. This department will manage the QRF (quick reaction force) and in organizing it at the local unions.

d. Women's Work Department. Their main role is the advancement of socialist cause in the women sector and in organizing women in factories, communities, schools and plantations.

e. Expansion Committee. Their main role is the expansion of the organization's membership in all factories, service sector and farm workers nationwide.

f. Finance Committee. Their main role is producing funds and resources of the organization.

g. Cultural Work Committee. Their main role is the propagation of progressive and working class culture in factories, service sectors and communities.

h. International Work Committee. Their main role is the expansion of networks outside the country, fraternity and getting international support.

ARTIKULO XI

PRINSIPYONG PANG-ORGANISASYON

Seksyon 1. Ang demokratikong sentralismo ang itataguyod ng BMP bilang pundamental na prinsipyong pang-organisasyon. Ang mga prinsipyong nilalaman nito ay ang mga sumusunod:

a. Prinsipyo ng halalan, pananagutan, at pag-alis sa posisyon ng mga halal na pinuno.

b. Pagkilala sa mga kapasyahan ng mga kasaping lokal na organisasyon at awtonomiya nito.

c. Karapatan sa pag-iral at kalayaan sa pagpapahayag ng minorya sa loob ng organisasyon.

d. Ganap na kalayaan sa pagpuna at pakikipagdebate hangga't di makasisira sa pagkakaisa at napagkaisahang desisyon.

e. Pagkakaisa sa pagkilos pagkatapos ng kapasyahan ng mayorya.

ARTICLE XI

ORGANIZATIONAL PRINCIPLE

Section 1. BMP will propagate democratic centralism as the fundamental organizational principle. The principles it contained are the following

a. Principles of election, responsibility, and position recall of elected officials.

b. Identifying the decision of the local organization members and its autonomy.

c. Right to exist and freedom of to speak of minorities within the organization.

d. Full freedom of criticism and engagement in debate as long as it will not destroy unity and decisions.

e. Unity in action after majority's decision.

ARTIKULO XII

ANG OPISYAL NA PAHAYAGAN

Seksyon 1. Regular na ilalathala ng Komite Sentral ang opisyal na pahayagan ng BMP, ang TAMBULI. Magsisilbing itong daluyan ng propaganda at ahitasyong kaugnay ng aping kalagayan ng uring manggagawa, kabulukan ng sistemang kapitalismo pakikibaka ng uring manggagawa sa bansa daigdig at daluyan ng ating mga paninindigan at panawagan.

Seksyon 2. Ang pambansang komite tagapagpaganap ang tatayong patnugutan ng dyaryo.

ARTICLE XII

OFFICIAL PUBLICATION

Section 1. The Central Committee will publish regularly Tambuli, the official publication of the BMP. This will serve as the organ of propaganda and agitation on the repressive situation of the working class, the rotten capitalist system, the struggle of the working class in the country and the world, and the organ of our stands and demands.

Section 2. The National Executive Committee will stand as the editorial board of the publication.

ARTIKULO XIII

PAARALANG MANGGAGAWA

Seksyon 1. Ang Paaralang Manggagawa ang magsisilbing pandayan ng sosyalistang kamulatan ng mga manggagawa at anakpawis at magsisilbing paaralang paghahalawan ng mga lider at kasapi ng kasanayan sa militanteng unyonismo at makauring linya.

ARTICLE XIII

WORKERS' SCHOOL

Section 1. The Workers' School will serve as foundry of socialist consciousness of the workers and the masses and will serve as school where leaders and members will be trained in militant unionism and class line.

ARTIKULO XIV

PANANALAPI

Seksyon 1. Ang pananalapi ng BMP ay nagmumula sa buwanang butaw ng mga kasapi, donasyon at mula sa mga proyektong pampinansyang inilulunsad.

Seksyon 2. Ang Pambansang IngatYaman ang mangunguna sa pangangalap ng pinansya at siyang mangangalaga ng kabuuang pondo ng organisasyon.

Seksyon 3. Ang donasyon at kontribusyon ay tatanggapin kung hindi makasasama sa integridad ng organisasyon, mga namumunong kapulungan at kasapian at di makaka-impluwensya sa mga programa, patakaran at mga proyekto ng BMP.

Seksyon 4. Obligasyon ng mga kasapi na suportahan ang lahat ng mga pagpapasulpot ng pinansya at proyekto ng BMP maging ang pangangalap ng mga materyal na suporta.

Seksyon 5. Ang itinakdang butaw ng indibidwal na kasapi ay P5.00 kada buwan.

Seksyon 6. Ang paglalagakang bangko ng BMP ay ang Banco De Oro na ang mga pangunahing signatories ay ang mga sumusunod: Pangulo, IngatYaman at Tagasuri.

ARTICLE XIV

FINANCE

Section 1. BMP's finance will come from the members' monthly dues, donations and from financial projects launched.

Section 2. The national treasurer will lead in fundraising campaign and will take care of the whole finances of the organization.

Section 3. Donations and contributions will be received if this will not tarnish the integrity of the organization, leading assemblies and members and cannot influence the programs, policies and projects of BMP.

Section 4. Members have the obligation to support all activities in raising funds and projects of the BMP, even in getting material supports.

Section 5. The dues set for individual members of the BMP are five pesos (P5.00) per month.

Section 6. BMP's depository bank will be the Banco De Oro, and the main signatories are the following: President, Treasurer, and Auditor.

ARTIKULO XV

PAG-AMYENDA NG SALIGANG BATAS

Seksyon 1. Ang anumang amyenda ay maisasagawa lamang ng mayoryang delegado sa anumang ilulunsad na regular o ispesyal na Pambansang Kongreso.

ARTICLE XV

CONSTITUTIONAL AMENDMENT

Section 1. Any amendment in this constitution will be done by the majority delegates of any regular or special National Congress.

ARTIKULO XVI

PAGTITIBAY AT PAGKAKABISA

Seksyon 1. Ang Saligang Batas na ito ay magkakabisa matapos pagtibayin ng Pambansang Kongreso.

Seksyon 2. Ang Saligang Batas na ito'y pinagtibay ng mayorya ng mga delegado ng Ikalimang Pambansang Kongreso ng BMP ngayong ika-14 ng Setyembre, 2008, sa Lungsod ng Baguio.

ARTICLE XVI

ADOPTION AND EFFECTIVITY

Section 1. This Constitution will become effective after adoption by the majority of the delegates of the National Congress.

Section 2. This Constitution has been amended by the majority delegates of the Fifth BMP National Congress this 14th of September, 2008, at in Baguio City.

SOLIDARITY OF FILIPINO WORKERS (BMP)


PREAMBLE

We, Filipino workers who have political awareness and class consciousness and we from the other sectors who have faith and in oneness with the great vision of the working class, aware about the extreme oppression experienced by the working masses under under the exploitative power of capital and all oppressor class, aware of the incessant need to fight for the welfare and well-being of the working class and unite with other oppressed classes, aware of the need to excite, unite and mobilize the working class for the realization of the socialist cause, and aware of the need for the working class to lead the Filipino people for democracy, freedom and independence; to lead the struggle of the entire working class for the realization of the socialist cause, now adopted this Constitution that will guide our Solidarity.


ARTICLE I
NAME OF THE ORGANIZATION

Section 1. Our organization will be known as BUKLURAN NG MANGGAGAWANG PILIPINO (SOLIDARITY OF FILIPINO WORKERS), and will be known in its acronym BMP.

Section 2. The current symbol and logo of the BMP has two hands with each one holding that hammer and two facing sickle behind it and BMP in the middle.

Section 3. The official song of BMP is the BMP Hymn, and BMP recognizes the International as universal song of the workers.

Section 4. The main headquarters of the BMP will be found in Metro Manila.


ARTICLE II
DECLARATION OF PRINCIPLES AND OBJECTIVES

Section 1. The highest principle of BMP is to aim and purify the role of working class in society and history and at all times will stand and fight for the interests and principles of the working class. All actions of the BMP shall came from this class perspective and here he should tbe tried and be identified.

Section 2. BMP believes that:
a. The fundamental interests of the working class is the advancement and fulfillment of his class struggle from the union level to political.
b. The only important thing that can exceed the principle of class struggle is the interest of the working class for a progressive society. Class struggle and social progress are the two basic interest of the working class.
c. This two basic interest is both represented by the worker's socialist mission in history.

Section 3. Class unity will be the basis for thepromotion of a strong workers' movement. This unity will be welded through organizing and planting class consciousness among the masses of the working class. On this basis we shall establish the organized strength of BMP, and this can serve as a strong backbone for the trade union movement in the country to move forward. This will be represented by the integration of socialist consciousness on the union struggle.

Section 4. But the emancipation of the working class from poverty and injustices cannot be achieved through trade union struggle only, the maximum gain is the improvement and ease the situation and agreement of subordination to the power of capital. The emancipation of the Filipino workers can only happen if his vision, unity and struggle would exceed the narrow walls of their factories and enterprises, and leaps in the level of class consciousness, solidarity and struggle for fundamental change of the exploitative system. Here are most basic importance and principles, to arouse, organize and mobilize the working class against capitalism as a system and to present socialism as the ultimate goal and aspirations of the working class in the country and around the world.

Section 5. At the current level of development of Philippine society, the liberation of the working class depends on the liberation of the Filipino people.The socialist cause of the working class will be realized if social progress will go forward in the country from the current backward state due to remnants of feudal order and stunted by the imperialist capital and power. In this basis, the aspiration of the Filipino masses for liberty and democracy is also the aspiration of the FIlipino workers, and the path towards socialism is the path of struggle for democracy and freedom of the country. It is the duty of the Filipino workers, not only to promote this struggle for democracy and liberty, but to lead the whole people in this struggle. The working class in the city and the countryside is the powerful force that can launch this struggle, and to all classes, the workers have the greatest interest in the complete victory of the struggle because through attaining democracy and liberty will clear the path of struggle towards socialism.

Section 6. Given the long oppression of the working class as wage slaves of capital is a global system, the struggle of Filipinos workers will inevitably have an international character. The liberation and development of the Philippines will not be realized as long as the power of imperialism rules the world. The full realization of the socialist mission of the working class in countries like the Philippines is decisively dependent on the growth of the international working class movement against global capital and power of imperialism. In this basis, the call "Workers of All Countries, Unite" is a central principle for BMP, and the struggle and victory of the Filipino workers against the domination of imperialism in our country is our greatest contribution to the workers' movement in the world.


ARTICLE III
MEMBERSHIP

Section 1. Membership. Every individuals, groups and organizations that believe in the BMP Constitution and believes in its socialist aim can become a member of BMP.

Section 2. Individuals who have outstanding contributions to the working class movement can be accepted as members in accordance with the decision of the Central Committee of the BMP.

Section 3. Organizations that can join BMP are unions and associations, socialist organizations and federations of urban poor and rural poor, youth organizations, women and cultural and other socialist organizations.

Section 4 The application for membership of an organization must be adopted by the National Executive Committee (NEC) or its authorized equivalent at the regional level after fulfilling the requirement set by the councils that will strengthen the application.

Section 5. Rights of members. The members have the following rights:
a. All delegates at the congress have the right to vote, run and be elected to any position.
b. All members have the right to participate and give opinions and positions in discussions and debate within the organization.
c. All members, individuals and member organizations, have the right to give their proposal to BMP, as well as comment on any members, officials and assembly of BMP.
d. All members have the right to know the status of the organization such as financial, membership and more.
e. Any organization / individual may resign as a member after stating the reasons and be decided upon by the competent assembly that will be organized by the NEC.
f. All members have an obligation to protect the interests and integrity of the organization.

Section 6. Obkligation of members. The members have the following obligations:
a. All members have the obligation to attend to meetings set forth by the BMP
b. All members have the obligation to attend all study courses decided by the central committee decided of BMP.
c. All members of the organization has an obligation to patronize all the issue of Tambuli and other official publications of the BMP.
d. All members have an obligation to pay their dues for the organization's fund.
e. All members have an obligation to participate in all approved actions and demands of BMP.
f. All members have an obligation to expand the membership of the BMP.


ARTICLE IV
THE NATIONAL CONGRESS

Section 1. The highest authority is the national congress to be held every three years. It is composed of delegates from member organizations / individuals.

Section 2. The National Congress will approve the general programs and policies, to amend the constitution and elect the members of central committee. The national congress will also elect its chairman.

Section 3. A special national congress will be held if necessary. Observance of special congress will be convened by two thirds (2 / 3) of the central committee or majority of member organizations.


ARTICLE V
THE CENTRAL COMMITTEE

Section 1. The central committee (CC) is the highest authority between congresses consisting of 31 elected members and the following automatic members:
a. Union presidents with membership of 300 and more;
b. The president of the socialist members from other local organizations; and
c. Presidents or chairmans of the chapters of buklod (nucleus of an organization)

Section 2. The central committee shall elect the members of the national executive committee.

Section 3. The Central Committee may develop departments and committees necessary for the implementation of the overall program and policies of Congress.

Section 4. The central committee will meet once every six months.

Section 5. The central committee has the duty to:
a. Make the necessary decisions and policy which are related to the programs made by congress.
b. Set specific targets for each area of ​​work required for the implementation of the program.
c. Make a plan of stages divided by six months for three years.

Section 6. May call for a special meeting of CC by the NEC or the petition of a simple majority of members of CC.

Section 7. Any CC member who commit offenses such as selling workers' interests and putting the organization and membership at risk may be terminated from office through two thirds (2 / 3) vote of the entire CC membership.

Section 8. The Central Committee are given the power to add staff at the time there are members who lie-low and while ongress is away. In essence it is the power to appoint a replacement or in addition to non-active members based on the principle of cooptation.
